Judges make rulings based on laws. Laws are at least in theory the will of the people and not people who are trying to break the laws.

Californian here. Propositions aren't laws. They go on the ballots and CAN be made into laws, or simply policies depending on what they do.

Now, don't get me wrong. Here's how it should have gone:

prop 187 passes

judge deems it "unconstitutional"

it goes to the Supreme Court

Supreme Court decides it is a fair interpretation of the law, and deems it "not unconstitutional"

Because the Supreme Court made this decision, it becomes "stare decisis" or, "the law of the land" and every state adopts it as law

Now...then governor Gray Davis, seeing that it was deemed "unconstitutional" instead of pursuing it as the will of the people, instead "takes it off his desk", making it a moot point.
Why do you think he did that?
a. It was deemed "unconstitutional" and that was the end of it?
b. The democrat governor, democrat party, democrat judge and democrat voters didn't want it to go to the Supreme Court and become the law of the land?
