Congress would need to flex it's interstate commerce regs to say basically the pill companies must have a standard price for all customers in the US and it will be the lowest one THEY use internationally.
Courts and lawyers won't be able to put a dent in that law because it literally allows companies to set whatever price they want still. It just has to be equal for everyone. No throwing insulin at state A for 5 a shot and state B for 10 a shot, and country B for 3 a shot. Everyone gets 3 a shot, or in practice, the company forces everyone to 10 a shot if they are the sole supplier. If competition exists, company drops it to market price globally.
Anyway, Big Pharma will pay off congress critters and none of this shit will get passed.

It would be an equality act - specifically that they can't charge multiple rates for all the insurance companies and overseas countries. Congress has the power, and it would certainly be legal. The law itself would dictate fines/fees/imprisonment.
But it will result in price of drugs rising where monopolies exist, and it could result in generics getting more expensive too if Big Pharma engages in price fixing. It also depends on how well EU keeps the prices tamped down.
